2020 Drinking Water Report 

Monday, August 7, 2017

Mayor Anderson called the meeting to order and opened with the Pledge of Allegiance. Town council members present: Jim Perkins, Lula Price, Tim Nottingham and Shirley Miller. PWD Mike Ventling, Chief of Police Ralph Dawson, Town Clerk Brenda Kansala and Town Attorney Hope Freeman were present.

 

Review and Adopt Agenda: Motion by Nottingham and seconded by Perkins to approve the agenda as written. Approved unanimously.

 

Public Comment (For those items Not on the agenda): Leza Vargas asked for clarification on ditch rights and water rights. Discussion held. Josh Jabalera from Midwest Assistance Program held discussion on income survey they did so town could get CDBG grant money for lagoons. He also discussed possible

personnel cut backs and stated to keep employees full time as will be even busier than ever with new upgrades coming. Nottingham asked Mayor Anderson about third party investigator regarding complaints that have come into to town for town employees. Mayor Anderson said he has not had any formal complaints but has had verbal complaints and does investigate and discuss with person involved. Mayor Anderson said town has had two special meetings to discuss it. Discussion held.

 

Minutes: Motion by Price and seconded by Miller to approve the minutes of the Regular Town Council Meeting of July 10, 2017.  Approved unanimously. Motion by Perkins and seconded by Price to approve the minutes of the Special Town Council Meeting of July 24, 2017. Approved unanimously.

 

Bills: Miller asked Ventling about the Town and Country bill for new tires for the dump truck. This bill was for one tire that had blown out. Clerk explained this total bill was split out into several different accounts. Discussion held on lawn sweeper. Motion by Price and seconded by Miller to accept the bills as presented. Approved unanimously.

 

Employee Reports:

Clerk report was read aloud by town clerk. Council received usage/billing summary, billing journal summary, accounts receivable summary, collections history, tax voucher detail, revenue voucher detail, combined check register, copy of Bank of Bridger bank statements, statement of expenditure budget vs actual and statement of revenue budget vs actual as reports. Nottingham had questions on billing journal summary in utility billing. Discussion held. Motion by Price and seconded by Perkins to accept the clerk report. Approved unanimously.

 

Public works report by Mike Ventling:Ventling stated will do street pothole repairing right now. Discussion held on new meter reading system from HD which is about 6 to 8 weeks out. Discussion held on water line to lagoon, parking blocks, street repairs and equipment and asphalt zipper. Asphalt runs about $50. a ton. Looking at about three dump-truck loads which is 15 ton over the next several weeks to do repairs. Tim and men from Bridger coming over next week. Mayor said can spend $5,000 to $6,000 on asphalt.  Discussion held. Motion by Price and seconded by Perkins to accept PWD report as presented. Approved unanimously.

 

Police report by Chief Ralph Dawson: Discussion held on trespass, theft, destruction of property, agency assists, suspicious vehicle, MIP 15 year old female, report of drunk driver, dog harassing goats and chickens, bear sighting, horses out, dog into rabbits, dogs at large, transport 15 year old female to youth detention, verbal threats, fireworks complaints, report of marijuana grow unfounded, vin inspection, parking issues and U Turn issues. Discussion on training attended and upcoming trainings. Mileage sheet included. Need new tires and getting bids. Motion by Price and seconded by Perkins to approve the police report. Approved unanimously.

 

Zoning Committee: Nothing.

 

Correspondence: Clerk gave to council confirmation dates for Fall Cleanup. Friday, Saturday and Sunday October 13, 14 and 15. Mayor Anderson said town received a letter from Attorney Freeman stating her last day with the town will be September 30, 2017. She has been with the town as our attorney for eight years. Mayor Anderson thanked her for all the work she has done. Mayor Anderson said the town will be needing to advertise for a new town attorney.

 

Mark and Leza Vargas – Barley Field: Mark and Leza Vargas gave to council a Buy-Sell Agreement to consider the purchase the Barley Field. Discussion held. The council will review. Attorney Freeman said it is alright for council to meet on this topic and post as a special meeting then call an executive session to discuss.

 

Tammy Taylor – Water Well At 123 1st Avenue: Cyrill Hergenrider was present for Tammy Taylor. Mayor Anderson said do not need to get town  permission need to call well driller and he sends paperwork to the state.

 

Poll Election: Mayor Anderson read the letter from the Carbon County Election Administrator asking if town would like to vote poll election or mail-in ballot election. Discussion held. Motion by Miller and seconded by Price for mail-in balloting election. Approved unanimously. Mayor Anderson read aloud Resolution #469 A Resolution To Establish The Method Of Holding The Municipal Elections Of  The Town Of  Fromberg, Montana. All signaled with an Aye. No one opposed. Approved unanimously.  Clerk to fax Resolution # 469 to Carbon County Election Administrator in Red Lodge.

 

Review Of  Revisions To Animal Control Ordinances: Attorney Freeman suggested council review the revisions and make suggestions or changes. Would like to have an act of discussion before changes made. Discussion held. Copy will be on counter at Fromberg Town Hall for review and will be on agenda at next council meeting in September.

Discussion held. Motion by Price and seconded by Nottingham to approve this ordinance. Approved unanimously. Attorney Hope Freeman read aloud as second reading Ordinance # 266 An Ordinance Amending Fromberg Code 2-3-11 Powers And Duties Of Police Chief. Motion by Price and seconded by Perkins to approve this ordinance. Discussion held. Yea by Price. Yea by Perkins. Nay by Nottingham. Abstain by Miller. Motion passes. Mayor Anderson read aloud as second reading Ordinance # 267 An Ordinance Repealing Fromberg Code 2-3-12 Powers Of Town Marshall In Its Entirety. No questions or comments. Motion by Nottingham and seconded by Perkins to approve this ordinance. Approved unanimously. Council member Miller read aloud as second reading Ordinance #268 An Ordinance Amending Fromberg Code 2-3-14 Records Of Traffic Violations. No questions or comments. Motion by Miller and seconded by Nottingham to approve this ordinance. Approved unanimously. Council member Price read aloud as second reading Ordinance #269 An Ordinance Repealing Fromberg Code 2-3-15 Emergency And Experimental Regulations. No questions or comments. Motion by Price and seconded by Miller to approve this ordinance. Approved unanimously. Attorney Hope Freeman read aloud as second reading Ordinance # 270 An Ordinance Repealing Fromberg Code 2-3-22 Direction of Traffic. No questions or comments. Motion by Miller and seconded by Nottingham to approve this ordinance. Approved unanimously. Attorney Hope Freeman read aloud as seconded reading Ordinance # 271 An Ordinance Amending Fromberg Code 2-3-23 Special Policeman. No questions or comments. Motion by Perkins and seconded by Price to approve this ordinance. Approved unanimously.

Motion by Nottingham and seconded by Perkins to approve this resolution. Approved unanimously. Attorney Hope Freeman read aloud as second reading Ordinance #273 An Ordinance Amending Fromberg Code 2-3-33 List Of Property Sold. No questions or comments. Motion by Miller and seconded by Nottingham to approve this ordinance. Approved unanimously.

 

Fiscal Year Budget: Council will have budget workshop open to the public Wednesday, August 16 at 7 PM. Motion by Miller and seconded by Price to defer discussion on budget until budget workshop on Wednesday, August 16.

 

Old Business: Mike Ventling discussed diverting traffic on 3rd Street during construction. Discussion held.

 

Next Regular Town Council Meeting Date: Monday, September 11, 2017 at 7:00 PM at the Town Hall of Fromberg.
